RCK Glow – General Terms and Conditions (B2C)

1. Scope and Contracting Party

These General Terms and Conditions ("Terms") apply to all orders placed by consumers through the online store operated under the brand RCK Glow at www.rckglow.com.

A consumer is any natural person acting for purposes that are wholly or mainly outside their trade, business, craft or profession.

These Terms apply in the version valid at the time of the order.

If you are a consumer residing in another EU Member State, you also benefit from any mandatory consumer protection provisions applicable in your country of residence.

2. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer but an invitation to place an order.

By clicking the "Buy Now", "Pay Now" or similar button during checkout, you submit a binding offer to purchase the selected products.

We will confirm receipt of your order immediately after submission by an automated email (“order receipt confirmation”). This confirmation does not constitute acceptance of your offer.

A contract is only concluded when we accept your order. Acceptance may occur either
(i) by sending you a separate order confirmation by email, or
(ii) by dispatching the ordered products (shipping confirmation), whichever occurs first.

We reserve the right to reject orders for objective reasons, in particular in cases of unavailability of products, incorrect pricing information, or suspected fraudulent activity. In such cases, any payment already made will be refunded without undue delay.

The contract language is English.

3. Prices and Taxes

All prices displayed in the online store include applicable statutory VAT unless otherwise stated.

Shipping costs are shown separately during the checkout process.

For deliveries within the European Union, VAT is charged according to applicable tax regulations, including the EU One Stop Shop (OSS) system where applicable.

4. Payment

Prices include VAT unless stated other.

We offer the payment methods displayed during checkout.

The availability of individual payment methods may vary depending on your country of residence and the outcome of automated risk assessments.

Payment is due immediately upon conclusion of the contract unless otherwise indicated during checkout.

5. Delivery

Delivery is carried out in accordance with our Shipping Policy.

6. Retention of Title

The products remain our property until full payment has been received.

7. Warranty Rights

Consumers are entitled to statutory warranty rights for defective products (2 years EU standard).

8. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations (“cardinal obligations”). Cardinal obligations are duties that are essential for the proper performance of the contract and on which the customer may regularly rely.

In such cases, our liability is limited to the foreseeable and typical damage at the time of conclusion of the contract.

Any further liability for slight negligence is excluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

9. Product Information

Product images are for illustrative purposes only.

Minor variations in packaging, appearance, labelling or design may occur and do not constitute a defect provided the product itself remains substantially unchanged.

Please follow all instructions, warnings and usage information provided with the products.

10. Alternative Dispute Resolution

The European Commission provides information regarding online dispute resolution and consumer dispute resolution mechanisms.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless mandatory law requires otherwise.

11. Applicable Law

These Terms shall be governed by the laws of Germany.

If you are a consumer residing in another EU Member State, you also enjoy the protection of mandatory provisions of the law of your country of residence.

12. Reference Clause 

Delivery, returns, refunds and withdrawal rights are governed by our separate policies, which form an integral part of these Terms.
